1. Acceptance of Terms

Welcome to DG Closet! These Terms of Service ("Terms") constitute a legally binding agreement between you and DG Closet ("we," "our," or "us") regarding your use of our mobile application and services.

1.1 Age Requirements

• Minimum Age: You must be at least 13 years old to use DG Closet.
• Ages 13-17: If you are between 13 and 17 years old, you must have parental or legal guardian consent to use our services.
• Parental Responsibility: Parents and guardians are responsible for monitoring and supervising their child's use of DG Closet.

1.2 Account Registration

To use DG Closet, you must create an account using one of the following methods:

• Email and password
• Apple Sign In
• Google Sign In

You agree to:

• Provide accurate and complete information
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

2. Description of Services

DG Closet provides a digital wardrobe management platform that includes:

2.1 Service Availability

• We strive to provide 99.9% uptime but do not guarantee uninterrupted access
• Services may be temporarily unavailable for maintenance, updates, or technical issues
• We reserve the right to modify, suspend, or discontinue features at any time with reasonable notice

2.2 Beta Features

Some features may be marked as "Beta" or "Experimental." These features:

• May not work perfectly or as expected
• May be changed or removed without notice
• Are provided "as is" without warranty

3. Acceptable Use Policy

3.1 Permitted Uses

You may use DG Closet for:

• Personal, non-commercial wardrobe management
• Creating outfits for your own use
• Organizing your personal clothing collection
• Sharing outfit ideas with friends (if we add social features in the future)

3.2 Prohibited Uses

• ❌ Upload content that you do not own or have rights to (e.g., stock photos, celebrity photos)
• ❌ Upload inappropriate, offensive, or sexually explicit images
• ❌ Upload images containing minors in inappropriate contexts
• ❌ Harass, abuse, or harm others
• ❌ Impersonate another person or entity
• ❌ Attempt to reverse engineer, decompile, or hack our services
• ❌ Use automated scripts, bots, or scraping tools
• ❌ Circumvent usage limits or access restrictions
• ❌ Resell or commercially exploit our services without permission
• ❌ Upload malware, viruses, or malicious code
• ❌ Violate any applicable laws or regulations
• ❌ Infringe on intellectual property rights of others

3.3 Content Guidelines

All photos you upload must:

• Be your own clothing items or photos you have permission to use
• Not contain nudity, violence, or illegal content
• Not violate trademark, copyright, or privacy rights
• Comply with our Community Guidelines (if applicable)

4. Intellectual Property Rights

4.1 Your Content

You retain ownership of all photos and content you upload to DG Closet.

License Grant: By uploading content, you grant us a limited, non-exclusive, royalty-free license to:

• Store your photos on our servers (AWS S3)
• Process your photos with AI services (Google Gemini, BiRefNet)
• Display your content back to you within the app
• Create derivative works (background-removed images, try-on results) for your use

What we do NOT do with your content:

• ❌ Use your photos for marketing or advertising
• ❌ Share your photos publicly without your permission
• ❌ Sell your photos to third parties
• ❌ Use your photos to train AI models (see Privacy Policy)

4.2 Our Intellectual Property

DG Closet and all related content, features, and functionality are owned by us and protected by:

• Copyright laws
• Trademark laws
• Trade secret laws
• Other intellectual property rights

You may NOT:

• Copy, modify, or create derivative works of our app
• Reverse engineer or decompile our software
• Use our name, logo, or branding without permission
• Remove copyright or proprietary notices

4.3 Trademark Attribution

DG Closet uses the following third-party services:

• "Google" and "Gemini" are trademarks of Google LLC
• "Apple" and "Sign in with Apple" are trademarks of Apple Inc.
• "Amazon Web Services" and "AWS" are trademarks of Amazon.com, Inc.

5. Account Termination

5.1 Termination by You

You may delete your account at any time by:

• Going to Profile → Settings → Delete Account in the app
• Emailing privacy@dgcloset.com

Upon deletion, your data will be removed as described in our Privacy Policy (30-day grace period, then permanent deletion).

5.2 Termination by Us

We reserve the right to suspend or terminate your account immediately, without notice, if:

• You violate these Terms of Service
• You violate our Acceptable Use Policy
• You engage in fraudulent or illegal activity
• You abuse our services or harm other users
• We are required to do so by law
• We discontinue the service entirely

5.3 Effect of Termination

Upon termination:

• Your access to DG Closet will be immediately revoked
• Your data will be deleted according to our Privacy Policy
• We are not liable for any loss resulting from termination
• Sections of these Terms that should survive (e.g., disclaimers, limitations of liability) remain in effect

6. AI Services and Third-Party Providers

6.1 Google Gemini AI

Our AI-powered features rely on Google's Gemini AI service. By using these features, you acknowledge:

• Your photos are sent to Google for processing
• Google's terms apply: Gemini API Terms
• AI results may not always be accurate
• Google does not use your data for AI training (paid API tier)

6.2 No Guarantee of Accuracy

6.3 Amazon Web Services (AWS)

Your data is stored on AWS infrastructure. AWS's terms apply: AWS Service Terms

7. Disclaimers and Limitations of Liability

7.1 Service "As Is"

We disclaim all warranties, express or implied, including:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or availability

7.2 No Warranty on AI Results

We do NOT warrant that:

• AI-generated clothing attributes will be accurate
• Outfit recommendations will suit your style
• Virtual try-on images will be realistic or accurate
• Background removal will work perfectly on all images

7.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are NOT liable for any indirect, incidental, special, consequential, or punitive damages
• We are NOT liable for loss of profits, data, or goodwill
• Our total liability to you is limited to $100 USD or the amount you paid us (whichever is greater)

7.4 Exceptions

Some jurisdictions do not allow limitations on warranties or liability. If you live in such a jurisdiction, some of the above limitations may not apply to you.

7.5 Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any laws or third-party rights
• Content you upload to DG Closet
• Your use of our services

8. Privacy and Data Protection

8.1 Key Privacy Points

• We collect: Email, name, photos you upload
• We share data with: AWS (storage), Google (AI processing), Apple/Google (authentication)
• We do NOT: Sell your data, track your location, or use photos for AI training
• You can: Access, export, or delete your data anytime

8.2 Data Retention

• Account deletion: 30-day grace period, then permanent deletion
• Backups: Retained for up to 90 days
• Try-on results: Auto-deleted after 90 days

8.3 Your Rights

Under GDPR, CCPA, and other privacy laws, you have the right to:

• Access your personal data
• Correct inaccurate data
• Delete your data ("right to be forgotten")
• Export your data in machine-readable format
• Object to certain data processing

9. Payment and Subscription (Future)

Current Status: DG Closet is currently free to use.

9.1 Future Pricing

We reserve the right to introduce paid features or subscriptions in the future. If we do:

• We will provide 30 days' advance notice
• Existing features will remain free (or you'll be grandfathered)
• Pricing will be clearly displayed before purchase
• Subscriptions will be billed through Apple App Store

9.2 Refunds

If paid features are introduced:

• Refunds will be handled according to Apple App Store policies
• We do not directly process refunds
• Contact Apple Support for refund requests

10. Dispute Resolution

10.1 Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

10.2 Informal Resolution

Before filing a legal claim, you agree to contact us at legal@dgcloset.com to attempt to resolve the dispute informally.

10.3 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration, except:

• Small claims court cases (under $10,000)
• Intellectual property disputes
• Claims for injunctive relief

10.4 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class action lawsuits, except where prohibited by law.

10.5 Jurisdiction

For disputes not subject to arbitration, you consent to the exclusive jurisdiction of courts in the United States.

11. Changes to Terms

11.1 Notification of Changes

We may update these Terms from time to time. When we do:

• Material changes: We will notify you via email and in-app notification at least 30 days before the changes take effect
• Minor changes: We will update the "Last Updated" date and post the new Terms

11.2 Acceptance of Changes

Continued use of DG Closet after changes take effect means you accept the new Terms. If you do not agree, you must stop using our services and delete your account.

12. Miscellaneous

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DG Closet.

12.3 No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

12.4 Assignment

We may assign these Terms to another entity. You may not assign your rights or obligations without our written consent.

12.5 Force Majeure

We are not liable for delays or failures due to events beyond our reasonable control (natural disasters, pandemics, government actions, etc.).

12.6 Export Controls

You agree to comply with all applicable export and import laws when using DG Closet.

12.7 U.S. Government Rights

If you are a U.S. Government entity, our software is a "commercial item" as defined in FAR 2.101.
